These Terms of Service ("Terms") govern your use of the Vendor mobile application ("App") and related services. Vendor is owned by Pamela Ferguson and operated at vendortcg.com ("we," "us," or "our"). By using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Service Description
Vendor is a subscription-based mobile app that provides real-time market pricing for trading card games — including Pokémon, Magic: The Gathering, and One Piece TCG — to help professional vendors make buy offers. The App identifies cards via camera scanning or manual search, retrieves current market pricing data, and assists vendors in building point-of-sale transactions.
2. Pricing Accuracy Disclaimer
Prices displayed in the App are derived from third-party market data sources and are provided for informational purposes only. We do not guarantee the accuracy, completeness, or timeliness of any pricing information. Market prices for trading cards fluctuate frequently and may differ from the prices displayed in the App at any given time. You assume all risk when making purchase, sale, or trade decisions based on pricing displayed in the App. We are not responsible for any financial loss resulting from reliance on pricing information provided by the App.
3. Subscriptions and Billing
Access to the App's pricing features requires a paid subscription. Subscriptions are available at $20 per month or $200 per year. All purchases are processed by Paddle.com as our Merchant of Record. Paddle handles all billing, tax collection, and payment processing. By purchasing a subscription, you also agree to Paddle's Buyer Terms.
Cancellation may be initiated at any time. Upon cancellation, your subscription remains active until the end of the current paid billing period.
4. Device Limit
Each subscription permits use on up to 2 simultaneous devices. Devices that have not been used for 30 consecutive days are automatically freed, making the slot available for a new device.
5. Data Handling
Deal data — including customer names, card values, and transaction amounts — is stored on your device only and is never transmitted to our server. The server receives card identification queries and your API key for authentication. No customer personally identifiable information is transmitted to or stored on our server. 6. Service Availability
The pricing service requires an internet connection and depends on third-party data providers. The service may be interrupted or unavailable due to network conditions, provider outages, or maintenance. When pricing data is unavailable, the App supports manual price entry so you can continue building transactions without interruption.
7. Limitation of Liability
To the maximum extent permitted by applicable law, our total liability to you for any claims arising from or related to your use of the App is limited to the amount you paid for your subscription in the 12 months preceding the claim. In no event shall we be liable for any consequential, incidental, indirect, special, or punitive damages, including but not limited to loss of profits, revenue, or business opportunities, regardless of whether we were advised of the possibility of such damages.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to conflict of law principles.
